Terms of Use

Last updated: November 3, 2026

The short version: you can use the app for yourself, a subscription renews until you cancel it, and the app is a habit tracker, not medical advice. The details are below.

1. Who we are

Top 1% Habits: Habit Tracker (“the app”) is an iPhone app provided by George James Boyle, an individual developer (“we”, “us”). By downloading or using the app, you agree to these terms. If you don’t agree, please don’t use the app.

2. Your license: Apple’s Standard EULA

The app is licensed to you, not sold. The base license is Apple’s Standard End User License Agreement (the “Standard EULA”): apple.com/legal/internet-services/itunes/dev/stdeula.

These terms add to the Standard EULA. They cover subscriptions, a health notice and a few other points. If they conflict with the Standard EULA about the license itself, the Standard EULA applies.

3. Subscriptions

To use the app you need an active subscription. There is no free trial. Subscriptions are sold through the App Store and handled by Apple. You see the price and the terms before you confirm.

PlanFirst periodThen
Weekly$0.99 for the first week$3.99 per week
Yearly$39.99 for the first year$39.99 per year
Second offer (shown once)$29.99 for the first year$29.99 per year

Prices are in US dollars. In other countries the App Store shows the price in your local currency, and tax may apply.

The $29.99 second offer

The app shows this offer once. If you take it, the price stays at $29.99 per year for as long as your subscription continues without a break. If you cancel and subscribe again later, the price shown to you at that time applies.

The $0.99 first week

The weekly plan costs $0.99 for its first week, then $3.99 per week. The first week lasts 7 days from the moment you start it, so a week started on Nov 1 covers Nov 1 to 7 and $3.99 is charged on Nov 8. The App Store decides whether you are eligible for the $0.99 week (usually once per Apple ID) and shows you the price before you confirm. If you cancel at least 24 hours before the first week ends, you won’t be charged again.

Payment

Payment is charged to your Apple ID at confirmation of purchase: $0.99 for the weekly plan’s first week, or the full year for a yearly plan.

Automatic renewal

Subscriptions renew automatically, for another week or year, unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for the renewal within 24 hours before the current period ends.

Manage or cancel

You can manage or cancel your subscription at any time in Settings › your name › Subscriptions on your iPhone. Cancel at least 24 hours before the period ends to avoid the next charge. After you cancel, Apple shows the date your access ends. Deleting the app does not cancel your subscription.

Restoring a purchase

If you reinstall the app or move to a new iPhone, use Restore in the app. It works with the Apple ID you bought with.

Refunds

Apple takes the payment, so Apple decides refunds. You can ask for one at reportaproblem.apple.com. We can’t see your payment details or refund you ourselves.

Price changes

If we change a price, Apple will tell you and, where the law or Apple requires it, ask for your agreement before you are charged the new price.

4. Your habit data

Your habits, goals and check-ins are stored only on your iPhone. We have no account system and no server that holds them, so we can’t see them and can’t get them back if your phone is lost, reset or the app is deleted. Keep your iPhone backed up. You can also export a CSV copy from the You tab. The Privacy Policy has the details.

5. Health notice

Top 1% Habits is a habit tracker. It is not a medical device, and nothing in it is medical advice, diagnosis or treatment.

6. Using the app

Use the app for yourself and for lawful purposes. Don’t copy it, resell it, reverse-engineer it, or try to get around the subscription, except where the law lets you. The app, its name, artwork and code belong to us or our licensors. The habits and goals you enter belong to you.

7. Changes to the app and these terms

We may update, change or stop parts of the app. We may also update these terms. When we do, we will change the “Last updated” date at the top of this page. If you keep using the app after that, you accept the updated terms.

8. No warranty, and limits on our liability

The app is provided “as is” and “as available”. We work to make it good, but we can’t promise it will always be available or free of errors.

To the extent the law allows, we are not liable for indirect or consequential losses, or for data lost from your device. Our total liability to you for anything to do with the app is limited to the amount you paid for it in the 12 months before the claim. Nothing in these terms limits any right you have by law that cannot be limited, such as consumer rights where you live.

9. Apple

Apple is not a party to these terms and has no obligation to provide support for the app. Apple and its subsidiaries are third-party beneficiaries of the Standard EULA.
